On The Problems And Perfection Of The Adult Guardianship System In Our Country

The purpose of the adult guardianship system is to protect the personal, property and other lawful rights and interests of the disabled person of the adult spirit. This system can achieve the full realization of the civil rights by making up for the ability of the obstacle. The system value of the adult guardianship system has been attached importance to by various countries. At present, Germany, Japan, France, the United States and other major civil law countries have developed a relatively perfect adult guardianship system. However, the development of adult guardianship system in our country is relatively late, the legislation is barren, and it is not easy to operate. Along with the aging society and the increase of mental illness, the old adult guardianship system has been unable to meet the social needs, it is difficult to play the real role of its system. On the basis of combining the experience of foreign successful legislation and the actual situation of our country, this paper puts forward suggestions for perfecting the system of adult guardianship in our country.
