| In this article, legal logic analysis methods were implemented to discuss the properties of personal online virtual assets. Firstly, we will talk about the concept of online virtual assets, then we will talk about our topics in this area by starting with the existing academic analysis discussions.This article is composed of three parts, the preface, the discussion and the conclusion. The body of discussion is divided into four chapters.In chapter one, the current academic discussion and dispute about legal properties of personal online virtual assets will be illustrated and analyzed.In chapter two, first part we will mainly discuss the judgment standard about what could be personal online virtual assets, in this chapter the topic will be discussed from both subjective and objective standpoint, subjectively the personal emotional value of these assets and the irreversible cost of one person once the assets have been lost, objectively the time and money the owner has spent on keeping these assets and also the usage frequency of these assets by the owner.In second part, we will mainly talk about the legal logical properties of personal interests of online virtual assets, it will be divided into two parts, the general legal properties and the special legal properties, because the personal interests of online virtual assets have properties of both online virtual assets and general assets of personal interests, so the comparison between these two will be used to discuss our topic.In chapter three, we will discuss the protection rule and foundation construction of personal interests online virtual assets, this part will be analyzed from three aspects,firstly, the theory foundation of the protection rule, secondly, the similar abroad cases and its results, thirdly, the incomplete and missing parts of this topic in current domestic laws.In chapter four, we will mainly discuss the construction of fundamental rules ofpersonal interest online assets, such as right acknowledgement rules, subject of right,punishment management, right deprivation and special regulation etc. |
