Comparative Study On Traffic Safety Related Crime

In recent years, drunk driving and dangerous driving behaviors causing traffic accidents are frequent. These caused the wide attention of the society. These dangerous driving behaviors causing crimes becomes a hot topic in the theory and practice.Because it is related to our life, the author will have a comparison for these related crimes.By Sun Mou drunk driving and Hu Mou racing case drawing out the problem,we point out the differences of traffic accident and the crime of endangering public security with a dangerous way. We mainly analyze the differences between indirect intent and negligence to carries on the comparison to the two crimes from the subjective aspect,At the same time we stress the point that this article mainly aimes at the method of driving cars hitting people, and we discuss the method from the risk and ways and purposes. In the meanwhile, we also distinguish traffic accident as a real harm and the crime of endangering public security with a dangerous method as a specific crimes, and introduct Sun Mou drunk driving case pointing out the problems that the author thinks.Crime of dangerous driving is closely related to the two crimes, the author will also analyze dangerous driving crime and the boundaries between the two crimes, and point out that traffic accident is the result of the crime of dangerous driving and analyze the differences between the two crimes from the crime constitution of the four elements. In the meanwhile, drunk driving and racing are two typical dangerous driving behaviors,we will analyze in detail. Dangerous driving crime and the crime of endangering public security with dangerous method are two dangerous crimes, and one is the abstract dangerous crimes, the other is the specific dangerous crimes. The differences between two kinds of dangerous crimes mainly depend on the nature of the illegal and dangerous properties of determinant standards.
