The Research On Export Credit Insurance Under Agreement On Subsidies And Countervailing Measures

Most countries under the framework of WTO hold strict attitude to any form of subsidies, however, with reference to export credit insurance,governments have reached a high degree of consistency allowing which exist by certain conditions. The Agreement on Subsidies and Countervailing Subsidies apply to export credit insurance, especially the annex Illustrative List of Export Subsidies article(J),(K) in which export credit insurance is prohibited subsidies. In 2014, China’s Ministry of Commerce approved license to 3 insurance companies of selling export credit insurance, while tracing back to 2013, the Supreme Court specified that if export credit insurance contract conflict with insurance law, insurance contract have priority. On the one hand, it is urgent to open export credit insurance market,on the other hand, research on characteristics of the export credit insurance is not sufficient and the legislation still needs to be improved.Therefore, this theses is aiming to point out our current deficiency of export credit insurance and make suggestion by analyzing basic elements of subsidies regulated by Agreement on Subsidies and Countervailing Subsidies.
