Study On The Right Of Jurisdiction In Overseas Chinese Divorce Case

Today, overseas Chinese divorce case is increasing with the growth of the number of residence in foreign.The law problem about overseas Chinese divorce case is a hot issue be concerned by Private international law academia. Now our country has not enough law activities about overseas Chinese divorce case. In judicial practice,there appeared in the parallel litigation,litigation concurrence, or the parties litigation slam shut, etc. So, in view of the actual state of legislation in the overseas Chinese divorce jurisdiction and the problems in the judicial practice,then determine the exercise of jurisdiction on the basis of overseas Chinese divorce. Put forward on legislation to permit the parties to a conditional agreement to determine divorce proceedings under the jurisdiction of the court. I advocate to apply the principles of appellate first priority and the optimization for inconvenient court principle in the judicial practice.
