Studies On Provisional Measures Of The International Tribunal On Law Of The Sea

International Tribunal on the Law of the Sea since its inception in 1996, there are many cases in which interim measures relate to this treatment, which is the International Tribunal on the Law of the Sea in this regard has the unique compulsory jurisdiction are inseparable. Given the importance of interim measures the jurisdiction of the International Tribunal for the Law, as well as many other doctrinal ambiguity of the International Tribunal for provisional measures in practice caused by the relevant international Tribunal "UNCLOS" and other temporary measures specified jurisdiction probe and few of its domestic far almost systematic research, so I mainly tried to provisional measures of the International Tribunal for the Law research, combine several for provisional measures to the International Tribunal for the processing of cases, the concept of interim measures, conditions, objectives and comply with other content specific analysis, and called on China should pay close attention and study of the relevant provisions of interim measures and practices. This paper is divided into four chapters.The first chapter, is mainly introduced in the Interim Measures for the most basic theoretical basis, mainly is carries on the description from the aspects of its definition, legal basis and purpose, and also to the provisions of the Interim Measures for several conditions and basic principles are summarized.In the second chapter specifically for the international maritime law court so far to deal with some of the cases to take temporary measures to carry out a detailed introduction, and the provisions of these cases of temporary measures to carry out specific analysis.The third chapter,at first, this paper analyzes some problems existing in the judgment standard and the execution of the interim measures, and then puts forward some personal opinions and views on these problems.
