Firstly, we Proceed from the concept and recognize its connotation, denotation, characteristics and value through the study of the historical development of the judicial rescue system. Then researching and analyzing foreign related systems, exploring the useful insights from the advanced theory and practice for perfecting our judicial rescue system on the legislative mode, on the application conditions, etc.Finally, analyzing the situation of the system in theory and practice and finding a series of problems and difficulties after analyzing the legislation in force and practice data of the district court.For example, provisions of the applicable conditions are too abstract, so the Court's discretion is too large, in practice. Moreover, its convergence does not close enough with other aid system, therefore, it is not conducive to maintain the rights and interests of the party. At the same time, on this basis, we propose some corresponding methods and measures. We are hoping to give some contribution to help improve the judicial rescue system.
