Based on the analysis of one classic case, this thesis points out that in finance lease deals, the lessor's ownship is often faced with a huge encroachment. the new finance lease judicial interpertation takes a stand on protecting the lessor's right, which conversely blurs the standard of the third party's duty of care. Bona fide acquisition fits so badly in finance lease deals that drives the writer to study on the base of bona fide acquisition. This paper finds that property publication and credibility system is the foundation of bona fida acquisition, however in finance lesae deals in china, this system has a lot of defects, which causes the imbalance mentiond above. Then this paper is about to value the realistic solutions from the angle of property publication and make some suggestion of improvement. In the last part, this paper proposes that the best way to fix the property publication and credibility system is to build the finance lease registration and then discusses how to bulid it.
