Socialfundraising means that ordinary citizens or organizations, to achieve particular relief purposes as well as to give aid to specific beneficiaries, spontaneously make public the deeds of raising money and goods from non-specific social public; it actively expresses the traditional Chinese merit in reality, that is, “one in trouble, all will help”nt of social undertakings fundraiser. The deed of socialfundraising is different from charity donation as the latter is standardized and adjusted by special legislation. However, there is nearly no legislation for social fundrasing. That also causes a series problems including unknown subject, non-standard supervision, dispute about the ownership of donated property, etc. The ownership attribution of social fundrasing is the most controversial issue which is repeatedly argued about by activity participants at court. It not only hurts donors' enthusiasm for charity, but also deters the undertaking of socialfundrasing from developing favorably.Under such background, this paper explores and analyzes the alteration process of right of property of socialfundrasing deed. The author believes there are also different kinds of socialfundrasing deeds inside themselves, so they should not be sorted into today's law system to be standardized.Through the perspective of the alteration of right of property, socialfundrasing deeds are attempted to be classified into two kinds, that is,“gifted contract with conditions”and “for the benefit of third party contract”, and then combined with the specific conditions during social donation practice. In this way, the ownership attribution of social donated property can be determined. Thus, this paper provides a new thought for solving the dispute about the ownership of social fundrasing property.
