The services provided by Chinese commercial banks have changed from free service to charged service. With the rapid development of the modern market economy, the increasing unreasonable fees charged by commercial banks have been questioned by people. Based on the legal relationships between banks and customers, the bank charges consist of three main parts: business assets charges, debt service charges, intermediary business fees. The main problems of bank charges in China are that the service fees vary from bank to bank but the difference is not clear for people and that the charging fees are always forced to pay and are bundled with the services.The two typical behaviors of commercial banks that are suspected of antitrust are monopoly agreements and abuse of market dominance. To analyze such behaviors and confirm the monopoly of commercial banks, we need to deduct and judge whether it is sufficient to take the behaviors of commercial banks as monopoly and whether there are some special reasons for commercial banks to charge the service fees.Currently, all of Chinese commercial banks should follow the antitrust law without special reasons. On the other hand, the antitrust regulations on commercial banks should be reasonable. The antitrust regulations on bank charges need to be consistent with the core values and the additional values of antitrust law. Now the antitrust regulations on bank charges still have some problems on legislation and law enforcement. To overcome the shortages, we should give suitable measurements, such as set different laws for different industries, improve the definitions of different industries and make them clearer, make the jurisdiction of antitrust agency clear, etc.
