Research On Adoption Of ICSID Arbitration In China BITS

The international centre for settlement of investment disputes is an organization which was established on solving disputes arise out of nationals of one contractual state and other contractual state. At early period the cases were accepted by the centre in accordance with the written agreement of consent by investor and contractual state to the arbitration. After 1990 s the centre began to accept cases which include clauses of consent to arbitration in BITs. Arbitration in centre is becoming the first remedy of settlement of disputes between investor of one contractual state and other contractual state pursuant to clauses in BITs or FTAs. Bits stipulated the arbitration in the centre as a remedy of settlement of disputes after our country's signing up the convention in 1990. What sort of change has done in BITs of our country? And how do BITs keep balance between the protection of investment from outside of the country and the protection of investment to the other country.
