| Our country is in the period of social transition. People’s thinking is changing, the view of marriage is changing, the rising divorce rate, lead to visit problem increasingly prominent. Our country’s visitation right system was formally fixed in the form of legal system in 2001 has been more and more highlight its shortcomings in the judicial practice. Therefore, improve the system of visitation right is of great significance for both theory and practice. In this paper, the study of visitation right system is divided into four chapters altogether. The first chapter, this paper expounds the meanings of the visitation right, nature, legislative purpose and the value of the visitation right system. The second chapter, analyzes the problems and deficiencies existing in the visitation right system in China. The third chapter, compares and analyzes of the visitation right system in China and abroad. The fourth chapter, this paper puts forward some proposals to perfect our visitation. Finally, I hope this article can for the improvement of the visitation right system theory and the judicial practice in our country play a reference role. |
