The thesis focuses mainly in shipper's rights of suit in respect of carriage of goods by sea. According to definitions of the Hamburg Rules and Maritime Code of the People's Republic of China, shippers can be defined into 2 categories namely the shipper and consignor, whereas Bills of Lading can either serve the purpose of documentation proofs for cargo collection or transferrable via blank endorsement. The undersigned wherefore, aims at analyzing shippers' rights of suit towards different shipping scenarios with different shippers, variations before & after transferring of Bills of Lading, mapping such scenarios against the basis of judicial precedents, domestic & international legislations & covenants. Hopefully through such analysis, shippers are better aware of their rights of suit, and are henceforth in a better position protecting their legitimate rights when they are subject to infringement from carriers. |
