The Logic And Path Of Research Of China's Local Governance By Law At The Basic Level

A document named ‘The decision of major issues aboutcomprehensively promoting the rule of law by the central committee of the communist party of China' was published in the party's the fourth Plenary Session of the 18 th CPC Central Committee. The decision has shown that China has entered a critical period in the overall promotion of the rule of law. In the period ofimplementing the thirteenth five-year plan and facing the risk of globalization, it is of great significance to explore the logic and path of China Local Governance of the rule of law. For a long time, many scholars at home and abroad have been devoted to exploring and studying the rule of law at the grassroots level in China. There are some professorsanalyzing the governance and research macroscopically; at the same time, some others prefer researching such standard with certain logic, specific methods and normative guidance. In addition, some scholars have been dedicated to deeply explore the rule of law in the path of grassroots governance. However, I hope that the grass-roots governance could be taken into the background of completing the managing system of China and improving the ability of governance in modernization. In order to provide useful and rational reference to enhance the capability of rule of law at the grass-roots level, it is essential to keep tight contact with the theme of the times and have deep consideration of the agreement of the party's the fourth Plenary Session of the 18 th CPC Central Committee. Furthermore, focusing on grassroots social governance of the rule of law logic and path, analyzing and controlling of internal logic and exploring the increasingly clear path of management can also be important for the realization of ideal governance.This essay will explore the logic and path of the rule of law in our country through three aspects. Firstly, there will be an explorationof the connotation,appearance, development and the significance of the legalization of grassroots governance. Moreover,the difference between this type of management and the traditional rule of human and the analysis of the relationship between governance and the rule of law can also be considered. Secondly, the logic of the transformation of China's local governance and the rule of law, the existing problems of these processes and their reasons, and the internal logic of the legalization of grass-roots governance will be discussed in details. Finally, there will be an analysis of the path of the grass-roots governance legalization in the transforming period, including the principle which should be followed, paths both external and internal and the specific choicestoimprove local governance of the rule of law in China.It will be an inevitable requirement for the rule of law to achieve democracy so that there can be along-term development in China. In current society, modern market economy has been extended to the whole social field and it can not be separated from the political democracy and the operation of the rule of law. Hence, we should develop the awareness of consciousness, self-confidence, independence and motivation of the rule of law and firmly believe the bright prospect of socialist democracy and the rule of law.
