On The System Of Chief Prosecutor

Mainland procuratorial organs in China adopt to gain approval of handling cases step by step, and this system has partly limited the specialization level of prosecutors and the improvement of case�handling efficiency gradually because of its administrative color. As a result, the responsibilities of dealing with cases legally have been unclear. So, the Third Plenary Session of the party's eighteenth approved the agreement:The decision of the Central Committee of the Communist Party of China on a number of major issues, which put forwards the thorough reform in the aspects of justice and will make sure that prosecutors exercise procuratorial power independently according to the laws, which will become on of the important jobs for the governing party. In December,2013, Supreme People's Procuratorate further regards getting rid of the administration, the local and inner administration as the important point of the reform. Following this, Chief prosecutor system is tried in Beijing Shanghai one by one. In addition, they summarize their advanced experience based on their practices, but there are many barriers still existing in this system. This article attempts to analyze the strengths and problems in the process of putting them into practice by analyzing Chief prosecutor system, compared with the research overseas, to explore the next development of exploring Chief prosecutor system and its reform.This article is divided into five parts. The introduction lays out the background and the significance of Chief prosecutor system. The first part mainly states what is Chief prosecutor system and how to understand Chief prosecutor system, so as to state the features of Chief prosecutor system.
