The Government Legal System Research In China

Government counsel system is a product of the Zeitgeist in a rule of law society.Its advent exemplifies the advance of law-based society,as it carries great significance in building a law-based administration of government.Currently,led by the Central Committee of Communist Party in China(CCCPC),administrative organs at various levels have set up Government Counsel Offices and Boards of Counsellors.Governmental legal counsel has been provided broadly across the country.However,because of the imbalance in development of regional economy and the lack of precedents in government counsel,there are a number of inadequacies in the Chinese government counsel system.The government counsel system has been developing slowly in the early stage of Chines Government.The booming period of government counsel hasn't begun until the past few years,after the CCCPC demanded a full establishment of the government counsel system.After a full inquiry in the archive,the author found that there isn't sufficient research on the subject of government counsel system in China:there are few number of published papers and treatise,most of which appeared in the past few years.The author analyzed the current government counsel system in China,with the thinking mode and knowledge in legal studies to the fullest extent,while employing Comparative Analysis method with reference to experiences in other countries.Thence,the author found certain practical suggestion on improving the system.This paper consists of the four following parts,which together form a detailed research on the policies of governmental legal counselling in China.Part?:Overview of government counsel.This part elaborates and analyzes the government counsel with particular emphasis in the aspects of its connotation,characteristic and significance.It gives a clear definition of government counsel and hence determines the specific object of discussion.Part?:Analysis on the current status and inadequacy of government counsel system in China.This part starts a wide-angle analysis on the process of establishing government counsel system,which is followed by a detailed discussion on the current development status.The author also provided specific examples of regulations in certain regions in the country.This part concludes with a summary of different kinds of problems in the systematic planning of government counsel.Part ?:Overview of the government counsel system in the United States and Hong Kong of China,with emphasis in their development and particular characteristics.The author compared these precedents with the current status of government counsel system in China's mainland,and proposed certain suggestions in these aspects.Part ?:Proposal of solving the problems in the government counsel system in China.The solutions involve five specific aspects:Optimization of the institutional setup,establishment of a robust lawyer-employment system,completing regulation by explicating the statue of responsibilities,introducing the appraisal system,securing the funding system.
