Research On The Right Guarantee System Of Prison Personnel

Persons who are serving a prison sentence for violating the criminal law shall be deprived of their personal freedom by law and detained in prison or detention house. From the international human rights convention and the provisions of the domestic legislation, the prisoners enjoy extensive basic rights, including the right to life and health, personality dignity, culture and education right and so on more than ten kinds of rights. Because of the public power and private rights are not equal, and the prisoners and separated from the outside, the right relief channel is not smooth, the lack of system security, the rights of vulnerable to infringement. Ensuring the rights of prisoners is an effective way to achieve social harmony, but also to maintain the real needs of the supervision of the good operation of the order. Whether the rights of prisoners can be effectively protected reflects the attitude of the state to respect human rights, but also a measure of the status of the development of human rights in a country. To guarantee the legal rights and the rights of prisoners is an important embodiment of the law enforcement of the national civilization, but also the necessary requirement of the legal system and the socialization of the prison work. Harmonious supervision environment is conducive to the promotion of social and economic development, to achieve long-term peace and stability in the country.In this paper, we will study the problem of the rights protection of prisoners in our country from the following five aspects. The first part of the history of protection of the rights of prisoners from China's prison system, the ancient system of sympathized with prisoners, the evolution of the rights of prisoners and the modern development of the rights of prisoners since; the second part summarizes the status quo of China's prison inmates rights protection, legal protection, and separately from the material social security, organizational security and safeguards four aspects in detail; the third part respectively from the right of survival and development, the protection of the right to relief the problems of China's prison inmates rights exist, including ensuring the right to survival on issues including the right to life in vulnerable and difficult to guarantee the right to health, right of personal dignity was ignored; the protection of the right to development on issues including the lack of education, protection of labor rights, social rights are difficult to implement the right to maintain. We are on the right of relief; security problems including the complaint and lack of right relief way, lawyers the right to intervene the lack of system design, commutation and parole right easily driven by interests; the fourth part discusses the value behind the lack of Chinese prison prison staff from the protection of the rights of human rights, democracy, rule of law, equality and justice in five aspects; the fifth part from perfecting related legislation and social consensus, the inmates of the rights of supervision and safeguard mechanism, broaden the rights of the four relief channels to put forward improving the supervision of the security personnel serving right the basic idea.
