Study On Illegal Evidence Exclusionary Rules

In criminal proceedings exclude evidence gathered by illegal means,that the proceedings of democratization and legalization inevitable requirement.Criminal exclusionary rule reflects the protection of human rights,justice,criminal effectiveness and many other values in the world has been widely recognized and applied.United States,Britain,Germany,Japan and other countries after a long practice,and establish a more mature criminal exclusionary rule,in the proceedings play an important role.At present,China's criminal illegal evidence exclusion rule has been initially established,but there are legislative rank low,is not clearly defined,operability is not strong,and the supporting system is imperfect and other defects.In this paper,the newly revised Criminal Procedure Law and relevant judicial interpretation basis for the discussion to explore the exclusionary rule in the country's develop-ment and the application,and then prospect of criminal proceedings trends.
