The concept of insurable interest originated in the 16 th century.It is a core issue in the study of insurance law now.But the scope of insurable interest is still a question.This article tries to find out the criteria of judging the scope of insurable interest for solving the question.This article includes five parts.The first part briefly describes the definition and types of insurable interests.The insurable interests include economic interests and personality interests.So the insurable interests can be classified into the economic insurable interests and the personality insurable interests by their respective nature.The second part briefly describes the definition of the scope of insurable interest.The third part briefly describes the criteria of judging the scope of insurable interest.The basic functions of insurable interest are the criteria.The insurable interest is the safeguard object of insurance and to avoid gambling and moral hazards.These are the basic functions of insurable interests,which is the criteria of judging the scope of insurable interest.The forth part briefly describes the scope of insurable interest in property insurance.The economic interests and personality interests can be insurable interests.In property insurance,the insurable interest belongs to the insured and is here from the day of the enforcement of an insurance contract to the end of the contract.The fifth part briefly describes the scope of the insurable interest in personal insurance.The economic interests and personality interests can be insurable interests.In personal insurance,the insurable interest belongs to the insured.And it belongs to the insurant also when the insurance is on the life of another and is here from the day of the enforcement of an insurance contract to the end of the contract.
