The Research On Anti-domestic Violence On Relevant Measures Of Victim's Rights Protection

In our country, the research circle has been concerned about the problem of family violence for a long time, and the state also attaches great importance to it. Prior to the introduction of special laws against family violence, the relevant provisions on the protection of family violence victims' rights and interests are relatively scattered, and there exists obvious shortcomings. In December 27,2015, the "NPC Standing Committee voted and passed through the "Anti family violence law of People's Republic of China" (hereinafter referred to as the "anti family violence law"), and implemented since March 1,2016, this special law which is aimed at anti family violence and safeguarding the rights and interests of victims has experienced a long journey of 20 years. With the publication of "Anti family violence law of People's Republic of China", the regulation of family violence in China has got a unified standard and legal basis.The purpose of this essay is taking the newly promulgated "anti family violence law" as the basis, through the research on the methods and measures of protecting the rights and interests of victims of family violence which was proposed in the anti family violence law, combining relative foreign system and protection measures, studying the measures of victim rights protection proposed in "anti family violence law". The author chooses several representative measures, analyzes the status of various measures'implementation and the problems encountered in the implementation process, and puts forward the methods to solve the problems, hoping to build up a perfect legal system of family violence victims'rights and interests protection which complying with the actual situation of China, so as to realize the legislation purpose of protecting family members" legitimate rights and interests, and promoting family harmony and social stability.
