Discussion On Legal Status Of Tube Baby And The Legalization Of Surrogacy

As affected by the increasing environmental changes and life pressure in recent years,fertility problem has started to draw attention from society.According to statistics,the percent of sterility is 10%to 15%.Many families lose their only child because of this special social background with aged couples who are not available to give birth to new life naturally.According to this background,'tube baby' as a new reproductive skill has been widely accepted by society.This new reproductive skill without natural intercourse has not only brought hopes to families but also a series of moral and legal problems as the plural parents and legal status of the tube baby.This thesis paper has discussed legal status of tube baby under circumstances that tube babies could be admitted as civil subjects.This paper discusses this question through domestic legal theories about the civil status of tube babies and foreign legal regulations on tube babies.This paper has 4 chapters.Chapter 1 briefly introduces the concept and types of tube babies,then discusses the legal status of tube babies with 'wife' as the birth mother.Chapter 2 analyses the concept of surrogacy and their civil status through their parentage.Chapter 3 elaborates present domestic situation and legislation of surrogacy.Chapter 4 is author's suggestions on normalization of surrogacy.
