Study On The Legal Issues Concerning The Customs Control Of Freedom Of Transit Goods

The title of this thesis is "Study on the Legal Issues Concerning the Customs Control of Freedom of Transit Goods".This paper is divided into six parts,mainly searching from the perspective of theory,legislation,judiciary,law enforcement.Chapter 1 of this paper discusses the theoretical basis of customs control of the freedom of transit goods.The traditional theory under the "Belt and Road Initiative"needs breakthrough,which laid the theoretical foundation for the topic.With the encouragement and obstruction from the international treaty of freedom of transit goods,Chapter 2 traces the historical development of international treaties,discusses the evolution from WTO rules to a higher standard of regional agreements and its controversy.Chapter 3 searches from the obstruction of extraterritorial legislation about the customs control of transit goods.Chapter 3 selects EU customs regulations and US domestic law and analyzes the problem of customs regulations of transit goods.Based on Chapter 3,from the theory to the practice,Chapter 4 analyzes the obstacle to the freedom of transit goods from judicial practice.Chapter 5 studies the implementation of "The Agreement on Trade Facilitation".First,the author studies the connection between the legislation of China and rules in "The Agreement on Trade Facilitation".Second,the author studies the enforcement of China under the regulation of "The Agreement on Trade Facilitation" about the customs control of the freedom of transit goods.Chapter 6 of this paper based on the foregoing,studies the innovation of the theoretical basis,when facing the difference of international treaties and extraterritorial legislation about the customs control of transit goods,the author suggest to sign bilateral and multilateral agreements of customs control of transit goods.At last,this chapter discusses the suggestion of facing with unfair judgment and the performance of "The Agreement on Trade Facilitation".
