Property Litigation Disputes In Divorce Cases Inquiry

In recent years,with the opening and development of society,people's thinking gradually changed,the corresponding values,views on marriage and other concepts thought is changing.The traditional thought of “single-mindedness” is sometimes begin to affect the stability of marriage and the family.The word “Divorce” is no longer a new word in our life,and the divorce rate has rose year after year.Based on the author's occupational substantive proceedings in divorce cases,the problems involved in such proceedings in addition to emotional breakdown and ownership of children,the division of property in divorce proceedings also becomes a major problem.And how does the real estate property split become the most complex focus.Therefore,property division issues become a big problem in divorce cases,and the problem of how to deal with this kind of problem relate to the appeal rate and the retrial rate of divorce proceedings.Handling the balance of division of property and clarifying legal relationship will help to improve the accuracy of the cases and to safeguard the legitimate rights and interests of the parties.It not only relates to whether the law truly reflects justice,but also relates to the social stability and unity.Therefore,the divorce proceedings in property dispute worthy of further study.This article commence from property disputes of the judicial practice,start on the basis of existing domestic scholars research results,in accordance with relevant laws and regulations,and with reference to marriage and family court cases integrated perspective,using empirical research methods,combined with similar cases in the region trial,points of divorce proceedings of the more common types of property division disputes analyzed in order to distinguish clearly one of the legal relationship.This paper includes three parts: Introduction,Body and Conclusion.The Body mainly through resettlement housing,affordable housing,parents financed the purchase of mortgage housing and housing reform in divorce proceedings titling and segmentation research.Four categories of cases will be used to identify the focus of controversy of the case.The author also tries to expand cases and find a final solution.The Conclusion summarized this paper.
