Labor disputes account for a large proportion of ordinary civil court and case acceptance amount.After the promulgation of litigation costs,the economic development level,the judicial environment,the people's legal philosophy have been a huge change.But court acceptance fees of labor-dispute cannot adapt to these changes.Keepping the status quo will be a burden to the court,but also affect the diversification of labor-dispute.This article focus on fees of institutional change from labor-dispute and running status of assessment and practical difficulties brought by the current charge standard,for the reason that the current collection standard is too simple,too low.Then put forward my own opinions.This article is divided into three parts except foreword and conclusion.Chapter 1:This part considers that the acceptance fee for labor disputes has gone through two stages:Combined-stage and Independent-stage.The former is the initial attempt to construct the charging system in our country.The latter gradually realized the standardization of the charging system.Chapter 2:This part mainly analyzes the real dilemma after the implementation of the standard of acceptance fee for labor disputes.The labor dispute case shows the non rational litigation tendency which is different from the ordinary civil dispute case.The standard stimulated the deterioration of a series of problems,for instance the trial funding constraints,the surge malicious litigation cases and so on.Chapter 3:This part is intended to adjust the acceptance criteria for labor dispute cases.This part analyzes the factors that should be followed and the principles that should be followed.This part carries on the concrete design to the collection standard of labor-dispute cases' acceptance fees.
