The Enlightenment Of The Ancient Chinese Idea-Harmony Between Man And Nature,on International Environmental Law Legislation

To improve the international environmental legislation system is the emphasis of international environmental legislation.The global environmental protection concept as the basic principle of environmental legislation,is an unavoidable content of the international legislative system.The purpose of international environmental laws isto achieve a basic value which international legislators realize by making environmental laws.The guiding ideology and targets of international environmental legislation are to make the human interests harmonious,to maintain economic and social sustainable development,and to protect the inherent rights and interests of human beings and natural objects.Judged bythe historical evolution and development of environmental law,contemporary environmental laws gradually develop into an emerging legal department,for the purpose of protecting natural resources.It has gone through three stages in general,namely periods of protecting natural resources out of their economic value as a single purpose,protecting living environment for the sake of their own interests of human beings,and protecting environment for the common interests of intergenerational and ecological interests.With the gradually serious international environmental problems,the closer international cooperation,and the change towards the purpose of international environmental law legislation,diversified development of legislation concept has been an unavoidable trend.It is practically significant to integrate the oriental culture,especially the ancient Chinese idea of "harmony between man and nature",with international environmental law legislation.This thesis pays priorities to improving the relationship between humanity and nature,with an attempt to apply the ancient Chinese idea of "harmony between man and nature"----the coexistence of man and nature,the harmony between man and society,and that mankind lives in harmony and peace,to environmental law legislation.We should attempt to make full use of the ancient Chinese idea of "harmony between man and nature" in the process of environmental legislation,which will exert such a great influence internationally that the formation of international environmental law legislation concept,with a basis of sustainable development principle and with an integration of the ancient Chinese idea of"harmony between man and nature",is discussed.The possibility of applying the ancient Chinese idea to international environmental law legislation is considered and made into reality.
