Research On The Legislation Of Disturbing The Medical Order

In November 1,2015,the thirty-first amendment to the criminal law(nine)incorporated the behavior of disrupting the medical order by the people’s Liberation Army into the scope of the criminal law,and regulated and regulated the crime of disrupting the social order by assembling people.But I think that the charges for the elements of the crime covers are not comprehensive,so this thesis in recent years,frequent crimes involving medical events as the background,select the three typical cases were analyzed,to explore the establishment of a separate "disrupt medical order crime" and set the legislative suggestion of transforming crime in the crime of disrupting medical order ".At the same time,the author proposes to further improve civil and administrative laws and regulations related to disturbing medical order,and eventually form the opinions of civil punishment,administrative punishment and criminal law punishment.This article is divided into the following three parts,as follows:The first part is the typical case.This section is divided into two sections.The first section is a brief introduction of typical cases,and the second section is a typical case analysis.A typical case of the introduction section selects three criminal cases involving doctors,through the comparison of the three cases,analyzes the difference between the crime mob to disturb social order and the crime of intentional homicide,crime mob to disturb social order and disturb the crime,finally summarizes the characteristics of medical order to disrupt behavior in the crime mob to disturb social order.This part describes from two aspects of our country and foreign countries,through the comparative analysis of our country and abroad for the regulation of the behavior of the status,and seek to learn from China to solve medical illegal crime path.The third part is the legislative conception of the crime of disturbing medical order.This section is composed of three sections.The first section reveals the harmfulness of disturbing the medical order,and the second section analyzes the defects of the crime of disrupting the social order,and the third section puts forward some legislative suggestions on the crime of disrupting medical order.
