Research On The Problem Of Difficult Starting To Criminal Retrial Procedure

Start the criminal retrial procedure timely and accurately get a fair trial,can make the case to wash grievances,innocent and is beneficial to correct the improper or wrong in judicial trial,in order to improve the credibility of criminal justice.In recent years,along with a series of cases of the parties and their families constantly apply for retrial,then start the difficult problems of criminal retrial procedure once again become the focus of public attention,caused the related people in theory and judicial practice of fierce debate.The criminal retrial procedure involves not only the stability of the law,but also the fairness of the law,which requires a balance between the two.However,the start of the criminal retrial procedure is a series of problems,including the primary problem is the criminal retrial startup,the theoretical circle is one of the reason has carried on the preliminary conclusion,mainly including the standard of retrial starting condition,minor three authority issues the interests of disputes and criminal appeal system is imperfect and so on.To solve these problems effectively,we need to improve the legal system of criminal complaints and reasonable determination of retrial.Moreover,the experience of criminal retrial procedures in countries outside the region of law is of benefit to our country.This paper is divided into three parts,the first part Outlines the relevant ideas of the criminal retrial procedure,and introduces the initiation of the foreign criminal retrial procedure.The second part focuses on the reasons for the difficulty of launching criminal retrial programs in China.In the third part,the reasons for the difficulty of the retrial program were put forward,and the corresponding solutions were proposed.
