Generally speaking,as traditional crime types,it is easy to make distinction between larceny and fraud.However,the means of crime are becoming increasingly complicated under the circumstances of the development of society,prosperity of economy and progress of science and technology.Thus,the phenomenon on cheating mingled with stealing appeared property crime.In the meanwhile,there are different qualitative conclusions facing same case facts.This thesis intends to discuss how to distinguish this situation through a case and provide some reference opinions for dealing with these two kinds of cases in judicial practice.First of all,we should understand the need for differentiation,that is the two crimes belong to different illegal types,and in the case of the same object with same victim,it is only possible to be mutually exclusive.Secondly,by understanding the objective aspects of the two crimes,mainly behavior,to make sure the importance of act of disposal on distinguishing the two crimes,and then to deepen the understanding by learning the subjective and objective aspects of act of disposal.Through the study of such typical cases,we learn how to apply theoretical knowledge to practice,and strengthen the ability to recognize cases and solve cases.Through research we distinguish such property violation cases,not only by means of obtaining property,should also consider whether the behavior acquires property because the victim makes his possession of the property a certain disposition and understandings the significance of this disposition of property subjectively,and then explore the action if it is based on the wrong understanding,and the aspects of knowledge of the transferred specific property to make a final determination.
