A Research On The Legal Protection Mechanism About The Legal Right To Education

In recent years,along with the development of the cause of higher education,the inequality hidden in the public colleges and universities enrollment system and in the process of recruit students is increasingly apparent,such as unclear power division between public college university and government,the provincial distribution of the enrollment system and the bonus policy for ethnic minorities.Citizen's equal right to education facing a huge challenge.How to regulate the right to recruit students in public colleges and universities to establish fair and reasonable enrollment system,perfect the relevant laws and regulations in the process of higher education recruit students and build the education equality legal protection mechanism,becoming a subject of both theory and practice,and it's also the focus in this paper.This article firstly expounds the background of the problem of students'equal right to education protection.At the same time,discusses the position of the equal right to education in law.Second,describes the concept about the legal right to education.Next,elaborates the situation and the legal basis about the public colleges and universities enrollment system.Then,discusses the present situation of college enrollment system in China,and analyzes the legitimacy of the policy in the college enrollment system,such as the bonus policy for ethnic minorities,the provincial distribution of the enrollment system and the different college entrance examination scores between provinces.On this basis,analyzes the cause of the inadequate protection about the equal right to education in our country's public college enrollment system.Last,gives some advice about establishing the equal right to education legal protection mechanism,such as putting forward the relevant measures from the legislative,administrative and judicial relief system respectively.Expecting improve the protection status about Citizen's equal right to education.
