Research On Speedy Trial Procedure Of Criminal Cases

With the rapid social development and progress,law governance is better executed,as a result of an increased number of trial cases year by year.However,the current number of trial court judges could not keep up with the increased caseloads.As the survey shows that the number of criminal cases are increased by 28%,while that of judges' is 3%.Thus China's criminal trial system has done a great effort to release the heavy pressure,including simplifying the procedure and initiating the speedy trial procedure of criminal cases.The speedy trial procedure of criminal cases was applied in 2015,with main characteristics of trial proceeding simplification,speedy trial flow and short duration.After one-year execution,the speedy trial procedure improved the trial efficiency significantly,and relieved the heavy caseloads.This paper analyzed the benefits and shortages of the speedy trial procedure,and suggestions are given,including increasing voluntary trial,compelled lawyer intervention regime,and changing the application scale.This paper includes the following six sections:The first part introduced the high court workloads and the background of promoting the speedy trial procedure of criminal cases.The second part discussed the problems during applying the speedy trial procedure of criminal cases in China.The third part analyzed the basic value of the speedy trial procedure of criminal cases.The fourth part compared speedy trial procedure of criminal cases with the foreign similar adjudication process.The fifth part talked about the revolution of the speedy trial procedure of criminal cases in China.The sixth part provided scientific analysis and reasonable recommendations on the speedy trial procedure of criminal cases.Besides,this paper could be used as a reference to the improvement of the domestic speedy trial procedure of criminal cases.
