Copyright collective management system refers to a transference of copyright from copyright owners to copyright collective management organization,which represents these owners to exercise this right,to fulfill the licensing contract,to ask for royalties,to participate in litigation and other activities.The modes of the collective management organizations in the world are divided into two types,monopoly mode and competition mode.The United Kingdom,the United States and Australia adopt competition mode.In this mode,the collective management organizations generally rely on the market order and self-discipline to standardize their behaviors.Because they are competitors,they will be more likely to attract much more owners by improving service.The monopoly mode,which is run by the administrative department,is allowed to set up a unique management organization in one field.China is using this kind of mode.No matter which mode,as long as the collective management organizations abuse their dominant positions to interfere the users and obligees,it will lead to a monopoly.In fact,in our country,Copyright Law of the People's Republic of China and Collective Management Rule of the Copyright are still not perfect.Therefore,using the Anti-monopoly Law of the People's Republic of China to restrict the collective management organizations is urgent and necessary.
