Legal Research About Application Of Equity Trust In China

Since the implementation of the Trust Law in China, the Trust has played an important role in expanding the investment channels for investors, accumulating diversified funds and promoting the development of the financial system, and has made indelible contributions to China's sustained economic growth. With the growing trust business, in today's trust market there have been a wide range of trust models, "equity trust" business is one of them. However, by many trusts carried out in full swing the so-called "equity trust" business, in fact, only by the name of equity trust to set up trust funds. In view of this, the author believe that through the writing of this paper to clarify the concept of equity trust, and as an equity management and investment to be analyzed and studied.Based on the essence of equity trust, this paper puts forward the author's independent opinions on the basic concept and characteristics of equity trust. Based on the present situation of China's trust market, this paper expounds why equity trust should be carried out in our country. Based on the provisions of the Company Law, the Trust Law and the Administrative Measures of the Trust Company, as well as the foundation of China's trust market, this paper also analyzes the feasibility of equity trust in China,the history and legislation of the similar equity trust system in foreign country and Taiwan region, and find out the reference significance for carrying out equity trust business in China.Based on the study of the basic theory of equity trust, the author will use his accumulated theoretical knowledge and research results, starting from the scope of application of equity trust, on this basis put forward the idea of building equity trust relationship, and the process of setting up the contract needs attention to the issue of one by one analysis. Finally, with the problems found in the construction of the equity trust contract and the shortcomings and shortcomings in the legislation system of our country today, this paper tries to put forward some suggestions to improve the legislation, with a view to providing some help for the development of the equity trust in our country.
