Electronic data is a new type of evidence in the criminal procedure law of 2012, and the electronic data obtained by various means is electronic evidence. Although China started the study of electronic evidence is not very late, but the electronic evidence in a separate category of evidence of formal use of time is not long, therefore, in the judicial practice of legal issues related to electronic evidence will be gradually revealed, the status of electronic evidence in criminal litigation will become more important in the. How to use electronic evidence reasonably and effectively in criminal procedure is the purpose of this paper. The author is in the electronic evidence forensics work, accumulated in the daily work of the case, and access to all kinds of references, the author hopes this article analyses problems of electronic evidence in the criminal procedure and evidence, and in what ways to solve these problems. After the brief introduction of electronic evidence, to understand the concept, categories and characteristics of electronic evidence; electronic evidence of inside and outside the region compared to understand the present situation of the research and legislation of electronic evidence in the world and in China; the analysis of the characteristics and problems of electronic evidence in criminal proceedings in all aspects of the work, the method for obtaining, fixation, preservation, examination and certification of electronic evidence; finally must solve the method of electronic evidence forensics procedures and norms perfect electronic evidence rules of this in the form of legislation to the standard. In this paper, the standardization of the procedures and rules are the focus, the author believes that today's China in the field of electronic evidence forensics is not without standards, but too much. Uniform and standardized electronic evidence collection procedure and standard rules are needed urgently in our country.
