The Impact Of The Protection Area Of High Seas On The Freedom Of High Seas

The marine environment and biodiversity of the high seas are declining,this long-term declining will be a serious threat to human society's sustainable development.Now,it is necessary for us to end the "disorder" of the high seas,and we should take appropriate methods for scientific management of the high seas,so that the high seas restore their original appearance.In order to meet the sustainable development of human society,we must protect the environment and resources in high seas.The protected area of high seas is the most advanced and effective environmental management tool in the field of marine environmental protection.They are accepted by many countries and international organizations.At the United Nations level,legislation is being actively pursued on this new system,and the impact of the new regime on the old principle of freedom of the high seas has been widely debated.In addition to the introduction and conclusion,this paper is divided into four parts.The first section provides an overview of the definition and development of the protection area of high seas,including the background of the creation and the different positions of the international community in the process of establishing the protection area of high seas.The international practice of existing the protection area of high seas is analyzed,and management measures in existing protection area of high seas are summarized.The second part mainly elaborates the conception and legal status of the high seas,the process of the establishment and evolution of the high seas freedoms,and analyzes in detail the basic connotations of the freedom of the high seas stipulated by the International Law of the Sea.The third part first discusses the reasons for the impact of the protection area of high seas on the high seas freedoms.Secondly,it summarizes that the status of the free use of the high seas is in the direction of gradual restriction,and then discusses how the management measures of the protection area of high seas can further affect the freedom of the high seas,especially the freedom of fishing,the freedom of navigation and the freedom of scientific research.The fourth part discusses the broad interests of our country in the high seas,and the establishment of the protection area of high seas will do what adverse effect on China's freedom right in the high seas,then this paper puts forward the countermeasures and suggestions on coping with the protection area of high seas.
