The Study Of Difficult Questions From The Crime Of Scalping Train Tickets Under ID-based System

The implementation of ID-based ticket booking system has curbed traditional scalping activities and to some extent improved the railway ticketing environment.But due to limited railway transport capacity,large mismatch between supply and demand as well as traceable flaws of ticketing system itself,a series of new scalping behaviors and approaches leveraging advanced technology and systematic operation have emerged.They severely interfere with the railway ticketing system,infringe passengers' legal rights and render market economic order chaotic.This thesis is comprised of five chapters.Chapter 1 starting with railway ID-based system researches on' the development of the ID-based system and the legal source of the crime of scalping train tickets.Chapter 2 discusses the controversy and dilemma of the judicial identification of scalping ticket crime under ID-based system.Chapter 3 expounds the criminal punishability of scalping ticket behaviors under ID-based system and conduct identification and analysis on them.Chapter 4 focuses on some tough questions from scalping ticket behaviors,such as snatching and hoarding tickets with ticket snatching tools,paid agent for ticket booking and purchasing,reselling and violation of citizens' ID information as well as its crime quantities.Chapter 5 discusses the improvement of legislation and jurisdiction on the crime of scalping train tickets.A final conclusion has been reached that the behaviors of scalping train tickets under ID-based system will still tremendously undermine the market economic order.Not only should the principle of conviction be stuck with,criminals be castigated and the criminal acts of scalping tickets be contained,but also the corresponding obligees' legal rights should be protected to facilitate the social development in a diverse and orderly manner.
