On The Application Of Public Order Reservation System In China's Foreign Marriage

Since the reform and opening up,with the increasingly frequent international exchanges,the number of marriages in China has increased year by year.In judicial practice,foreign marriage parties marriage behavior if the violation of foreign public interests in our country,our country court will invoke the public order reservation system of foreign—related marriage effect denied.The development of private international law in a sense is applying of the development of foreign law system.But in some cases,the application of foreign laws will damage the interests of the country,so certain measures must be taken to limit it.The reservation of public order system is the private international law system,which has such a function.The article plans through case analysis,discusses the application of public order system in the foreign marriage in the plan through analyzing the connotation of public interest of foreign,combined with the reservation of public order legislation and development at home and abroad,according to the current law of our country,put forward the system of reservation of public order in solving the problems and disputes of foreign—related marriage improvement suggestions.The main body of the article is divided into five parts.First,the introduction describes the research purpose and the significance of this study,put forward the research method and research;Second is the public order reservation system overview,introduces three typical cases,relevant concepts and expounds the controversy to be solved in this article;Then introduces the foreign public order legislation.Finally,introduces the legislative status of the reservation of public order in our country.Through comparative analysis of the "the People's Republic of China laws applicable to foreign-related civil relations law"(hereinafter referred to as "the laws applicable to foreign-related act")issued relevant provisions before.Around this case,asking questions and giving suggestions for improvement..
