When engaged in the economic activity,the house is absolutely necessary.Rental housing is not the only way to solve the housing problem,but it is still a main way to solve it.There is a large proportion of low-income people in China who can't buy their own house,and could do noting but leasing house to solve their housing problem.The lessee is particularly disadvantaged in the parties of the lease contract.Their rights are more vulnerable to be ignored and violated.Such as the leaser raise the rent at will,the leaser's policy rescission right is too loose.The house-leasing contact without day can't protect the lessee.And they are causing a lot of housing-leasing issues.They are not only affecting the lessee' s dwelling environment.but also affecting social stability.So it's necessary to protect the lessee's rights.Our country has a low priority to protect the lessee' right of dwelling environment for now.The research emphases about protecting the lessee focus on the principal of sales cannot break lease,the right of preemption and so on.Our country's research of the rental housing is in the early stage.It is places emphasis on protecting the principal of freedom of contract,ignored the special of house-leasing contract,and maintained the leasehold relation's stability.As for the lessee is particularly disadvantaged in the rental market,and the necessary to protect the lessee' s right of dwelling environment.In consideration of the historical development bears similarities between China and Korea.But in Korea,the system to protecting the lessee in rental relationship is ripe.The Korea's housing lease act provides some references for China.Especially in making law to protect the lessee.The houses being discussed in this article are residence building.This article can be divided to five chapters.The first chapter is introduction,mainly talk about the significant of the subjects,the background of the subject,the range of study and the research method.The second chapter states the historical development of the Korea's housing lease act and the meaning for protect the lessee.The third chapter combined with specific cases to state the relevant content about the lessee' s protection in this law.The forth chapter states the relevant laws and regulations of the housing rental in China.And the significance of the Korea' s housing lease act.The fifth chapter sorts a series of methods of improving recitation strategy based on the past research results and the substantial evidence worked out in this paper.
