Studying On The Infringement Of Citizen's Personal Information-read<Criminal Law Amendment(9)>Article 17

In recent years,with the rapid development of economy and the rapid progress in science and technology,strengthening network penetration,constantly improve the network information technology,information age has come.Internet information age in the study work life brought the convenience to citizens at the same time,a large number of citizens'personal information leakage situation happen from time to tome,disturbed state of citizen information management order,and subsequently induce a lot of online fraud,extortion,invade the computer information system and other crimes,citizens' personal and property rights have been infringed,affect social harmony and stability.Now our country has not yet been introduced the personal information protection act,to some extent increase the risk of citizens' personal information leakage.In order to strengthen the protection of citizens' personal information,2009,"criminal law amendment(7)" article 9 and creativity to set up a sale or illegally provide citizens personal information crime and illegal for citizens' personal information,the two crimes will infringe on their citizen's personal information behavior into the category of criminal law regulation,filled in the our country civil personal information protection legislation in blank.In 2015,"criminal law amendment(9)" article 17 to the criminal law amendment(7)of article 9 of the two charges combined for the infringement of citizens' personal information,to further expand the crime subject,modify the crime behavior,improve the legal punishment of crime,further improve the legal protection of citizens' personal information system.But due to the infringement of citizens' personal information crime belongs to the general rules,there is no corresponding judicial interpretation for its further how to understand and apply,many are still controversial,is not fully regulation form and means of diversified crime in judicial practice,to be specific.By the purpose of this paper is to study of infringement of citizens' personal information crime legislation present situation,analyzing the imperfection of the infringement of citizens'personal information crime,at the same time,other country advanced experience of citizens'personal information protection of the criminal law,perfect the protection of citizens' personal information security in our country.
