Research On Punitive Compensation System In Food Safety Industry In China

On April 7,2015,the revised Food Safety Law came into effect after repeated calls.After that,the punitive compensation system in the newly-issued law was again the hottest topic.The improvement of the punitive compensation in the food safety industry was doubtlessly a significant breakthrough.However,many food safety issues still remained unsolved in the fast development of the economy.From the standpoint of the operator,the punitive compensation system in the food safety industry was like a timebomb,a real-time warning and deterrence of food safety violation for the food producers and sellers;while for the consumers,the improved punitive compensation system could help them protect their own lawful rights and interests by lawsuit.The society is propelling forward,and any laws or regulations cannot adequately cover all issues as expected,because they just regulate what existed and what people predicted that might exist.Therefore,we should view it all-around with justice.The essay,a research on the punitive compensation system in food safety industry in China,analyzed the current compensation system and pointed out problems in practical implementation of the system with personal proposals and advices to improve the system.The first part was a general statement on the background and the significance of the research,the related viewpoints of experts in the field,both domestic and foreign,and the research methods of this essay.The second part reviewed the punitive compensation system in food safety industry in China and introduction of related systems in characters and functions,so that the system could be better understood.The third part focused on the counterpart systems in Taiwan and foreign countries,like USA,Germany,and an effort of improving our own system with reference to theirs.The fourth part was on the current situation of legislation and implementation of the punitive compensation system on food safety in China today to explore the problems in our country,so that urgency of more improvement in the system was revealed and stressed.The final part proposed measurements to improve the system in the future.
