The Analysis Of Financial Legal Mechanism For Poverty Alleviation In Chinese Rural Areas From The Perspective Of Law-economy

With the problem of poverty being a world-class one,poverty alleviation and development is an important task in building socialism with Chinese characteristics,which is also the important way to realize the common prosperity of socialism.The 5th Plenary Session of the 18 th National Congress of the CPC proposed that we would build a well-off society in an all-round way by 2020.The 13 th Five Year Plan points out," Rural poverty population is out of poverty under the current standards in China,and poor counties all removes poverty in order to solve the regional overall poverty".Rural financial poverty alleviation is the powerful weapon to solve the problem of poverty.Finance,as the blood of the modern economy,plays crucial role for poverty alleviation,and the financial means is a controller for balanced resources for poverty alleviation,and is also the promoter of poverty-stricken areas to drive innovation.But financial with its many characteristics,such as liquidity and risk,Must have a complete legal system to guide them.In the light of the future financial poverty alleviation size being increasing,it is imminent to study the problem of rural poverty alleviation financial legal mechanism.This paper uses the theory and method of economics and law to analyze rural financial legal mechanism for poverty alleviation,using economics principle,trying to base on cost-benefit analysis of legislation and supply-demand analysis of institutional,as well as legal concept,legislation system and law enforcement system,etc,to analyze rural financial theory foundation and endogenous logic for poverty alleviation in China,and considering economic and social factors' influence on China's rural financial law mechanism for poverty alleviation,to explain the problems and deep reasons existed in the current rural financial law for poverty alleviation mechanism.By using the method of law and economic crossover study,making economic development law as the breakthrough point,it will make the interdisciplinary research for rural financial legal mechanism for poverty alleviation in China,in order to solve the long-standing financial shortage in rural poor areas through the legal regulation.At the same time,through the analysis of domestic and foreign experience of advanced financial legal mechanism for poverty alleviation,it concludes enlightenment to perfect legal mechanism for poverty alleviation in rural finance in China.Finally,based on China's current economic and social situation,it puts forward the idea of rural financial legal mechanism for poverty alleviation in China.The difficulty of this paper is to clarify the historical logic and the status quo of rural financial legal mechanism for poverty alleviation development,and analyzes its true reason.The innovation of this article lies in conducting a comprehensive analysis of rural financial legal mechanism for poverty alleviation in China,summarizing and combing the main content to explore deep causes of the problem.Through analysis of the current development situation of financial legal economics for poverty alleviation,adhering to the combination of normative and empirical analysis,by the method of economic research,it clarifies the concept of legal system.On the one hand,from the internal logic aspect,it emphasizes perfecting rural financial legal mechanism for poverty alleviation;on the other hand,from the supply and demand aspect,it puts forward a sound system of legal mechanism with rural financial for poverty alleviation.
