A Study On Theinternal Supervision Of Administrative Discretion

With the deepening development of the socialist market economy with Chinese characteristics,the reforms of the Chinese political system and economic system have entered a new stage,and the problems faced by Chinese administrative law enforcement personnel at the exercise of administrative discretion are becoming more and more complicated.Owing to the combined effects of external and internal factors,a part of the administrative law enforcement personnel have the abuse of administrative discretion.Therefore we should strengthen constantly external supervision,and at the same time,we need to explore ways of strengthening internal supervision.Through the understanding of the related implication of the internal supervision of administrative discretion,this paper analyzes the advantages and disadvantages of the external supervision and internal supervision of administrative discretion.The internal supervision of administrative discretion can help to play the subjective initiative of the people,help to improve the effectiveness of control of administrative discretion,and help to fill the legal vacuum zone.We should further promote internal supervision on the control of administrative discretion.In the process of analyzing the internal supervision of administrative discretion,we can find that there are still weak links.Firstly,the laws and regulations of the internal supervision of Chinese administrative discretion are not perfect;secondly,the control authority of the internal administration cannot fully play its effective role;thirdly,the structure of the internal supervision mechanism is not reasonable.In order to strengthen the effectiveness of the internal supervision on the control of administrative discretion,we should proceed from the following aspects.We should strengthen the process control of administrative discretion,improved continuously the discretion of the benchmark system of administrative discretion,further improve the system of the internal supervision of administrative discretion,improve the comprehensive quality of administrative law enforcement personnel and establish an administrative precedent system.Through the above ways,it is necessary to strengthen the internal supervision on the control of administrative discretion,improve the scientific nature,rationality and legitimacy of the administrative law enforcement personnel at the exercise of administrative discretion and safeguard the legitimate interests of each citizen.
