Discussion On Improper Network Appeal Of Individuals And Relative Law&Regulation

This research studies the improper network appeal of individuals.Considering the general background of the network society and typical cases happened recently,it analyzes the actual forms and social damages of such behavior and further explores its legal and social causes.It also proposes to formulate legal regulations and measures to reduce and prevent such behavior so as to facilitate sound development of network appeal by individuals.Improper network appeal is a special behavior of individual seeking help from the network.It refers to the behavior where an individual publicizes his needs for help or seeks help from the society and others via the network in an improper and unlawful manner,which refer to the following behavior conducted by an individual when seeking help: make false statement or conduct fraud;exaggerate or hide relevant information;disclose untruthful information to earn others' sympathy or kindness;forge or alter the statement of donations in order to occupy and keep such property for himself.Improper network appeal infringes upon the legal interests of the donors and other help-seekers,fails public trust and kindness and sabotages the order of charitable donation.Upon analyzing typical cases and relevant laws and regulations,it is suggested main reasons for such behavior mainly include: lack of clear standard of qualified subjects;lack of a credibility assessment system;lack of protection of personal privacy;lack of regulation on the network appeal platform;and ambiguity in statement of donations and ownership of the remaining donation.The following measures shall be taken in order to regulate improper network appeal,safeguard the legal interests of lawful help-seekers using the network,and promote sound development of network appeal: First,accelerate legislation to improve laws and regulations on network appeal by individuals,make a clear definition and clarify relevant legal concepts such as “network appeal of individuals” and “public donation of individuals”;specify rights and obligations of the parties involved;and standardize the accountability mechanism.Second,establish a complete regulatory system of network appeal and an integrated regulatory system before,during and after the event,and construct an all-round regulation model covering the network platform,professional institutions and collaboration of mass media.Third,establish a standardized information platform for network appeal.Last,establish a strict assessment mechanism of individual credit,set up a database for citizen credit levels and formulate a complete punishment mechanism for dishonesty.
