Film and television work is a comprehensive art form which can give the audience both visual and auditory artistic feelings.With the rapid development of the film and television industry,the originality of the film and television works has become a key factor in the success of the film and television works.Unfortunately,this principle is not accepted by all,which causes plagiarism.This is called "hitchhiking" behavior should arouse great attention,it is not only very easy to damage the original rights of creative enthusiasm,but also hinder the development of the film industry.In the case of infringement of film and television works,the originality judgment of film and television works has become a difficult problem in judicial practice,and the court has not reached a consensus on the standards and subjects of originality in the course of the trial.Therefore,it is very necessary to study the originality of film and television works.Taking the originality of film and television works as the starting point,we hope that we can provide theoretical support for judicial practice and safeguard the legitimate rights and interests of copyright holders and realize the balance of interests.This paper is divided into four parts to analyze the originality of film and television works.The first part is an overview of the film and television works originality as the starting point,the definition of film and television works and the originality of the concept,and based on the concept in the clear analysis of the film originality,as discussed later pave the way for.The second part is to investigate and summarize the standards of originality of works both at home and abroad,and get the inspiration of the creative standards of film and television work for the purpose of independent,creative and targeted creation.The third part is mainly through the domestic and foreign related cases,discussed in the specific judicial practice,domestic and foreign film and television works for the originality of the identification,and identification of at home and abroad were analyzed,and the main body that the principle should be summed up the film and television works the determination of originality and the suitable identification method.The fourth part mainly discusses the protection of the originality of Chinese film and television works.By analyzing the current situation and limitations of the protection methods used in China,the author puts forward some suggestions for improving the originality protection of Chinese film and television works.
