Study On The Protection Of Reputation Rights In China's Network Live

With the rapid development of the cyber technology in our country,the Webcast has came into being and now,as a newborn cyber industry,is becoming more and more popular.However,while the Webcast developed constantly,there are also many legally controversial problems appears,especially the cases of defamation.Protecting the right of reputation in the Webcast is very important,which is the key to maintain the cyber environment and makes it more harmonious and stable.Thus,it is very necessary to study the issues of protecting the right of reputation in Webcast.This thesis is mainly about the protection of the right of reputation in civil law.We will analyze the imperfections in the existing civil law and the real cases in the webcast to improve the legal regulations about the reputation-protection issues in our country.Furthermore,we will give more suggestions about how to improve the reputation-protection during the Webcast in the civil law.In the first chapter,we mainly introduced the overall problems on the "reputation-protection in the Webcast" issues existing in our civil law.Firstly,we will clarify and generalize the concept and the nature of "reputation-protection in the Webcast" and then,we will make a contrast about the different ways of reputation-protection in the Webcast between the civil law and other laws.In this way,we can conclude the particularities of the civil law and lastly,we will analyze the specific domain of the reputation-protection problem in the civil law in a detailed way.In the second chapter,we put our focus on the ways of reputation-protection in the Webcast in our civil law.We studied the boundaries of reputation-protection in the Webcasts which involves public characters and the average people.Then we will summarize the specific ways in which they are protected in the Webcast.In the third chapter,we will analyze the limitations and problems existing in our civil law in the aspect of reputation-protection in the Webcast.Our analysis is based on the problems and disadvantages existing in our present civil law about the reputation-protection in the Webcast.Besides,through analyzing the current status,we will also try to analyze the issue that actually what causes these limitations and problems.In the fourth chapter,we will give more suggestions on how to improve reputation-protection in the Webcast through our civil law.On one hand,we should perfect our reputation-protection in the Webcast through legislative amendment.On the other hand,we need to thoroughly study the real and practical conflictions and limitations existing in the Webcasts to build the legal system in which reputation-protection in the Webcast can be fully realized.
