Study On The Insurable Interest In Property Insurance

China's insurance industry has developed rapidly in recent years,it is because the increasingly perfect market economic system,active in the insurance market.With the development of the insurance industry,insurance types increase,the visible mass for the insurance demand is also changing,so the adjustment of insurance activities of the law need to be perfected.The insurance interest is a the basic principle of insurance law,insurance contract has the evaluation function,and has the effect on the regulation of duplication and excess insurance.Because our insurance law can not be synchronized with the needs of society,so there are a large number of insurance contract disputes.In these disputes,involving most of the property insurance accounted for,and much of this dispute is the source In the insurance interest.At present,China's regulations on the insurance interests of the insurance law are is too principled,it is precisely because there is no clear regulations,which leads to many problems in the application of the time,and scholars on the insurance interest is frequently discussed.So the study of property insurance in the insurance interest is very necessary,not only conducive to the insurance legislation,but also to promote the development of the insurance business,more positive effect on the improvement of insurance theory.This paper is divided into three parts.In the first part introduces the basic theory of insurance system and insurance benefits.In the second part discusses the subject of insurance interests,insurance interests time,transfer scope of insurable interest and insurable interest problems on these four issues,through the analysis of foreign legislation and scholars have different views and ideas.The first part introduces the theory and some problems of the second part of the paper,in the last part of the article analysis on the problems in the legislation of insurance interest and suggestions to solve these problems.I hope through this article about insurance interest in property insurance is introduced,some problems for the interests of property insurance and elaborates on the improvement of China's insurance legislation,can provide a favorable reference for the definition of insurable interest,also can promote to perfect our insurance law.
