The Legal Liability Of Discredit In Enterprises

Modern market economy is the credit economy,but in China's economic field,there is a more serious phenomenon of dishonesty.At present,it has not yet formed a system of credit legal system,disciplinary research on dishonesty is still in the initial stage,and the legal liability system for enterprise dishonesty is further studied.Since 2014,China has gradually begun to promote the credit system reform.November 11,2015,the Nat ional Development and Reform Commission,the State Administration for Industry and Commerce officially released the " Memorandum of Cooperative Supervision and Joint Disciplinary Cooperation of Dishonest Enterprise ",which is the third large-scale joint credit disciplinary action taken by the relevant departments of our country.However,in terms of the current legislation of enterprise dishonesty,there are still the following problems: legislation is lagging behind;the lack of operability of the law;the mechanism of dishonesty is not perfect;enterprise credit service system is not suited and so on.This paper is an in-depth analysis of this problem,through the improvement of the implementation of the "blacklist" system;Doing a good job of corporate credit accountability basis jobs;the implementation of joint disciplinary measures;exploring the special duty of dishonesty and the form of rights relief,creatively put forward to establish a sound On the Legal Responsibility System of Corporate Credit i n China.
