It is recognized that the platform of Cross-border electronic commerce can offer a predominant price for purchase foreign products.There are more cornsumers pursuing this transaction,and relevant demands of Cross-border logistics may get an upward tendency.Therefore,logistics industry in China should reconsider its own development and positioning;in particular with e-commerce circumstances,intension and extension of Third Party Logistics(TPL)shall expand constantly in the future.As an innovative logistics schema,TPL has many individual advantages compared with traditional logistics.It seems to match appropriate logistics resources with different logistics demanders,and it is probably to reach the maximum utility in cross-border electronic commerce.There is a possibility that the dispute in TPL mainly from logistics contract during the practice,such as the nature of contract,the location of operator in TPL,the institution of logistics responsibility,Cross-border judicial litigation and consumer analysis.The essay will introduce an analysis regards the lag of current legislation and scattered issues in TPL.According to progressive logistics legislative regulation and practical experience in other countries,China will create a logistics programmatic document as a guide specification to clarify the basic concept of legislation in TPL.It is likely to accumulate practical experience and theoretical basis to establish a national logistics legal norm by adopting independent legislation pattern in various regions.Moreover,the ODR can dispose the Cross-border logistics problems,which may avoid high judicial cost of Cross-border and reduce the complexity of implementation.In order to ensure that logistics can be operated smoothly during Cross-border e-commerce,TPL should improve substantive law and procedural legislation,which can assist to offer a superior service for Cross-border consumers and facilitate Cross-border e-commerce performance expanding.
