Research On Pharmaceutical Intellectual Property Protection Rules Under Trans-Pacific Partnership Agreement

The purpose of this paper is to study the pharmaceutical intellectual property protection system norms under Trans-Pacific Partnership Agreement(TPP).At present,scholars at home and abroad has obtained certain achievements of pharmaceutical intellectual property protection under Trans-Pacific Partnership Agreement,but on the whole the study of TPP agreement on intellectual property rights,especially the research of drug patent protection problems and experimental data is not sufficient.The pact of TPP is a product of compromise of the developed countries and developing countries signed the agreement,carefully study the intellectual property system of TPP agreement has important significance to help China to better deal with patent medicine globalization trend,breakthrough the patent firewall made by developed countries and build Chinese characteristics pharmaceutical intellectual property rights protection system in the field of international trade;As president Trump of United States has made the decision to exit the pact of TPP,the future of the TPP doesn't seem to be the light,the influence of TPP terms may reduce,but the countries signed the agreement still occupy an important share in the drug trade over the Pacific rim,and we can not rule out the possibility of China to join the TPP,terms of the TPP will remain important influence that can not be ignored on the global pharmaceutical intellectual property rights protection process.This paper is divided into five chapters:the first chapter summarizes the current situation of global pharmaceuticals trade,the definition of the protection of intellectual property rights of medicines,clarify the research object of this paper,established the research basis of this article;The second chapter is the translation,research and analysis about the main content of the TPP agreement pharmaceutical intellectual property rights(IPR)protection clause,which is the core content and value of this article;The third chapter analyzes the TPP agreement with the current international treaty particularly drugs as well as the similarities and differences of the protection of intellectual property rights in TRIPs agreement,highlights the pact of TPP pharmaceutical intellectual property protection clause is the advanced,its degree of protection of intellectual property rights of pharmaceutical broke through the traditional international treaties and international agreements,the strictness is unprecedented;The fourth chapter details the significance provisions of TPP agreement of pharmaceutical intellectual property protection clause characteristic,international trade agreements of pharmaceutical intellectual property rights(IPR)protection to China and its influence on traditional Chinese medicine and generics industry in China,puts forward possible solutions for our country to deal with the pact in pharmaceutical intellectual property right protection,and high demand groundwork for our country to build and perfect the medical trade to intellectual property protection system.This article is in reference on the basis of predecessors' research achievements of drugs to the concept and significance of patent protection,studied aspects of drug experimental data and the compulsory licensing provisions of the pact,discusses the similarities and differences between TPP on terms with the current international treaty,and points out innovation and the foot of the pact is discussed with intellectual property of pharmaceutical patent protection provisions of,explore the TPP agreement about the terms of the set in the international trade agreements on Chinese medicine terms of reference of intellectual property protection and tries to find out China's measures for the terms about the TPP agreement and be perfected.
