The Principle Of Perpetrator Of Status Crime Begins With The Distinction Between Domination And Obligation

During the individual crime,the identity never cause any confuse,but when it combines with the actor,it cause so many problems becomes a desperate passage and a deep mire?When several people conduct a common crime,how to determine whether he or she is perpetrator or not is the core' While the number of people is not.So,when identity combines with the actor,we should pay attention to both of them,but not the how many of them.Due to the present research always make the identity of the ontology in priority,but such way never makes the problems easy.More importantly,when basic theoretical research is not that clear,how can we make it clear when it combines with the identity?That's why we put the principle of the distinction between perpetrator and accomplice in priority.Based on this,there are four parts of this paper:The first part,based on the present research try to find the core of the problems when it comes to identity and the distinction between perpetrator and accomplice.Try to start from the problem and make the distinction between perpettrator and accomplice in priority.The second part,clarify the concept of perpetrator to build a solid platform for dialogue and communication.Then,card the mainstream theory and the representative theory of the constitutive elements,grab domination and obligations which are the core elements of perpetrator in the trend of substantial constitutive elements and distinguish domination and obligations.The third part,try to avoid making mistakes when identify whether he or she is perpetrator.Based on the second part,the perpetrator divided into the behavior control and the obligation offense.At the same time,in order to strengthen the understanding of the theory of perpetrator,analysis the integration between subjective and objective of the substantial constitutive elements.The last part,based on the former research,is mainly to reconstruct the concept of identity crime and to build the principle of perpetrator of status crime.
