A Study On The Legalization Of Risk Assessment Of Major Administrative Decision

At the Fourth Plenary Session of the Eighteenth Central Committee of the Communist Party of China(CPC),the first time that China passed the form of the plenary session,it will comprehensively promote the establishment and finalization of the basic rule of governing the country according to law.The meeting also stressed that the collective discussion of the decision,the legitimacy of the review,risk assessment,expert demonstration,public participation in the major administrative decision-making legal procedures to promote the improvement of legal decision-making mechanism,the formation of the responsibility of the system,the formation of a major decision-making lifelong accountability system,The establishment of administrative organs within the major decision-making legitimacy review mechanism.This is the key measure to promote the rule of law and the development of the rule of law.In today's society,the very popular social code of conduct and political principles is to enforce the rule of law,but also a major trend in domestic political development.Comprehensive,overall,extensive is a prominent feature of major administrative decision-making,as an important part of administrative management,much attention..In recent years,the local legislation in our country,the development of normative documents on major administrative decision-making,at the same time,emerge in an endless stream just unfolding;the rule of law in the process of major administrative decision-making risk assessment is relatively lagging behind.The risk assessment of the major administrative decision-making is lack of laws and regulations,and still can not be fully integrated into the framework of administrative law.Place on the major administrative decision-making risk assessment standards vary,the level of institutionalization is uneven,there are many issues to be clarified.The paper consists of four parts.The first part is the basic theory of the rule of law in risk assessment of major administrative decision-making.The second part focuses on the analysis of the problems existing in the process of the legalization of major administrative decision-making risk assessment in China.The third part of the United States and the United Kingdom as an example to study the major administrative decision-making risk assessment system,and on the basis of the analysis of the extraterritorial system.The last part is based on the existence of the relevant issues,targeted in-depth discussion of the realization of the major administrative risk assessment of the legal advice and recommendations.
